成都金融城投資發(fā)展有限責(zé)任公司作為征集人（下稱“征集人”）委托上海國際招標(biāo)有限公司作為征集代理（下稱“征集代理”），組織“成都交子公園金融商務(wù)區(qū)22#、12#地塊建筑概念方案國際征集”活動(dòng)，面向全球公開邀請(qǐng)具有相關(guān)設(shè)計(jì)經(jīng)驗(yàn)的設(shè)計(jì)機(jī)構(gòu)前來申請(qǐng)應(yīng)征，遞交資格預(yù)審《申請(qǐng)文件》。申請(qǐng)人可以申請(qǐng)參加一個(gè)地塊或兩個(gè)地塊的資格預(yù)審。征集人將通過本次資格預(yù)審，為每個(gè)地塊各擇優(yōu)選取6位應(yīng)征人參加征集活動(dòng)。《征集文件》（含《設(shè)計(jì)任務(wù)書》）僅提供給入圍的應(yīng)征人。兩個(gè)地塊的優(yōu)勝方案和中選方案可以來自同一個(gè)應(yīng)征人或者不同的應(yīng)征人。

CHENGDU FINANCIAL CITY INVESTMENT&DEVELOPMENT CO.,LTD. (hereinafter referred to as the Sponsor) and Shanghai International Tendering Co. Ltd. (hereinafter referred to as the Solicitation Agency) are now jointly soliciting proposals for Architectural Conceptual Scheme of Block 22# & 12# in Chengdu Jiaozi Park Financial and Business Zone. We publicly invite design institutions worldwide with related design experience to participate and submit the APPLICATION DOCUMENTS for Prequalification. Applicants can apply prequalification for one or both two blocks. Six Participants will be selected through prequalification to participate in the solicitation activities for each block. The SOLICITATION DOCUMENTS (including the Design Program Document) will only be provided to the selected Participants. The potential and final winning schemes for two blocks may come from same or different Participants.

一、征集背景/The Background of Solicitation

為落實(shí)國家戰(zhàn)略，助力建設(shè)國家西部金融中心，加快融入“成渝雙城經(jīng)濟(jì)圈”戰(zhàn)略，提升交子公園金融商務(wù)區(qū)形象，征集人擬全力打造以人為本、體現(xiàn)國際先進(jìn)理念、金融總部特質(zhì)、綠色、智能的地標(biāo)項(xiàng)目，特向全球優(yōu)秀設(shè)計(jì)機(jī)構(gòu)征集交子公園金融商務(wù)區(qū)22#、12#地塊的建筑概念設(shè)計(jì)方案，引入國際標(biāo)準(zhǔn)世界眼光的規(guī)劃建設(shè)理念，精細(xì)化、高標(biāo)準(zhǔn)完成建筑設(shè)計(jì)方案，打造具備鮮明的識(shí)別性和影響力的金融行業(yè)地標(biāo)建筑”

In order to implement the national strategy, help to build the national western financial center, accelerate the integration into the two cities economic circle of Chengdu and Chongqing and enhance the image of Jiaozi Park Financial and Business Zone, the Sponsor intends to make every effort to build a people-oriented green intelligent landmark reflecting international advanced concept and financial headquarters character by soliciting PROPOSAL for Architectural Conceptual Scheme of Chengdu Jiaozi Park Financial and Business Zone Block 22# & 12#..

二、征集程序/The Procedures of Solicitation

1.資格預(yù)審/ Prequalification

征集人將組建資格預(yù)審評(píng)審委員會(huì)，對(duì)按時(shí)遞交了資格預(yù)審《申請(qǐng)文件》的應(yīng)征申請(qǐng)人進(jìn)行審查和評(píng)審，為每個(gè)地塊各擇優(yōu)選取6位應(yīng)征人參加征集活動(dòng)。兩個(gè)地塊的應(yīng)征人可以是相同或不同的申請(qǐng)人。

The Sponsor will set up a prequalification evaluation committee to examine and evaluate the APPLICATION DOCUMENTS for Prequalification. Six Participants will be selected through prequalification to participate in the solicitation activities for each block. Participants of the two blocks may be the same Applicants or different Applicants.

2.概念方案評(píng)審/Conceptual scheme Evaluation

征集人將組建方案評(píng)審專家評(píng)審委員會(huì)，對(duì)應(yīng)征的概念方案及其它相關(guān)內(nèi)容進(jìn)行綜合評(píng)比，針對(duì)每個(gè)地塊各評(píng)選出3個(gè)優(yōu)勝方案。

The Sponsor will set up a scheme evaluation committee to comprehensively evaluate the conceptual schemes and recommends three potential winning schemes for each block.

3.中選方案的確定/Final Winner

征集人在向相關(guān)主管單位和部門匯報(bào)了專家評(píng)審結(jié)果，并征詢了相關(guān)主管單位和部門的意見后，在每個(gè)地塊的3個(gè)優(yōu)勝方案中各確定1個(gè)中選方案。

After reporting the scheme evaluation result to the governmental authorities and consulting with such authorities, the Sponsor will determine one of the three potential winning schemes as the final winning scheme for each block.

4.深化設(shè)計(jì)咨詢/Further Design Consultation

每個(gè)地塊概念方案中選的應(yīng)征人將根據(jù)征集人的委托，對(duì)該地塊的概念方案進(jìn)行深化，提供建筑方案設(shè)計(jì)咨詢或建筑初步設(shè)計(jì)咨詢服務(wù)。深化設(shè)計(jì)咨詢費(fèi)由應(yīng)征人自行報(bào)價(jià)，是《應(yīng)征文件》的組成部分。深化設(shè)計(jì)咨詢費(fèi)的報(bào)價(jià)將被作為方案評(píng)審的考慮因素之一。

The final winner of each block will provide further design consultation such as architectural scheme design consulting or architectural design development consulting services according to the entrustment of the Sponsor. The further consultation fee is quoted by the Participant, which is an integral part of the PROPOSAL. The quotation of further consultation fee will be considered as one of the factors for scheme evaluation.

六、申請(qǐng)人的資格要求/ Eligibility and Qualifications Requirements

1.申請(qǐng)人應(yīng)為合法注冊(cè)的法人實(shí)體；

2.1注冊(cè)在中華人民共和國境內(nèi)的申請(qǐng)人應(yīng)具備中華人民共和國住房和城鄉(xiāng)建設(shè)部核準(zhǔn)的建筑行業(yè)（建筑工程）設(shè)計(jì)甲級(jí)及以上資質(zhì)或建筑設(shè)計(jì)事務(wù)所甲級(jí)資質(zhì)；

The Applicant with business license registered inside the People's Republic of China shall have Grade A architecture design qualification certified by the Ministry of housing and urban rural development of the people's Republic of China.

2.2注冊(cè)在中華人民共和國境外的申請(qǐng)人須依本國或本地區(qū)的規(guī)定具備建筑設(shè)計(jì)的執(zhí)業(yè)許可或經(jīng)營許可。港澳臺(tái)地區(qū)申請(qǐng)人的資格要求參照境外申請(qǐng)人資格要求的規(guī)定；

申請(qǐng)人應(yīng)在上海國際招標(biāo)有限公司網(wǎng)站（www.shabidding.com）上進(jìn)行供應(yīng)商注冊(cè)并下載《資格預(yù)審文件》。已經(jīng)注冊(cè)過的申請(qǐng)人可使用已有的供應(yīng)商登錄名和密碼登錄后，進(jìn)入本公告頁面，點(diǎn)擊右上角“領(lǐng)購”按鈕下載《資格預(yù)審文件》。

十、方案征集費(fèi)、獎(jiǎng)金和深化設(shè)計(jì)咨詢費(fèi)/ Solicitation Fee, Bonus and Further Consultation Fee

1.方案征集費(fèi)/Solicitation Fee

征集人將向遞交了完整和有效的《應(yīng)征文件》的應(yīng)征人支付方案征集費(fèi)。每個(gè)地塊每個(gè)方案的征集費(fèi)為人民幣80萬元。

For each block the Sponsor will pay a solicitation fee of RMB 0.8M to each Participant who submitted complete and valid PROPOSAL for each blocks. PROPOSAL

2.當(dāng)應(yīng)征人出現(xiàn)下列情況時(shí)，征集人不予支付方案征集費(fèi)：

Under the following circumstances the Sponsor is entitled to refuse to pay the solicitation fee:

2.1應(yīng)征人未按規(guī)定時(shí)間遞交完整的《應(yīng)征文件》；

PROPOSAL is not submitted on time and completely;

2.2應(yīng)征人遞交的《應(yīng)征文件》被專家評(píng)審委員會(huì)認(rèn)定為未對(duì)《征集文件》的要求作出實(shí)質(zhì)性的響應(yīng)；

PROPOSAL is judged by the scheme evaluation committee not substantially responding to the requirements of the solicitation documents;

2.3方案征集期間，應(yīng)征人的資格條件發(fā)生變化，不能達(dá)到上述第六條規(guī)定的資格要求，被征集人取消應(yīng)征人資格。

During the period of solicitation, the qualification conditions of the Participant have changed and cannot meet the requirements of the above Article 6 Eligibility and Qualifications Requirements.

3.獎(jiǎng)金/ Bonus

3.1每個(gè)地塊各設(shè)置3個(gè)優(yōu)勝方案獎(jiǎng)，每個(gè)優(yōu)勝方案的獎(jiǎng)金為人民幣40萬元；

For each block, a bonus of RMB0.4M will be awarded to each Participant whose scheme is recommended as one of the three potential winning schemes.

3.2每個(gè)地塊的中選方案將另外獲得獎(jiǎng)金人民幣60萬元。中選方案的應(yīng)征人應(yīng)配合征集人向政府主管部門進(jìn)行方案匯報(bào)，并根據(jù)主管部門及方案評(píng)審專家的意見對(duì)中選方案進(jìn)行優(yōu)化。優(yōu)化工作僅限于概念方案深度。

For each block, a bonus of RMB0.6M will be additionally awarded to the Participant whose scheme is the final winning scheme. The final winner of each block shall cooperate with the Sponsor to report the scheme to the governmental authorities and optimize the scheme according to the opinions of the governmental authorities and scheme evaluation committee. The optimization work is limited to the depth of the conceptual scheme.

4.深化設(shè)計(jì)咨詢費(fèi)/ Further Consultation Fee

每個(gè)地塊的概念方案中選人將根據(jù)征集人的委托，對(duì)概念方案進(jìn)行深化，提供建筑方案設(shè)計(jì)咨詢或建筑初步設(shè)計(jì)咨詢服務(wù)。深化設(shè)計(jì)咨詢費(fèi)由應(yīng)征人自行報(bào)價(jià)，是《應(yīng)征文件》的組成部分。深化設(shè)計(jì)咨詢費(fèi)的報(bào)價(jià)將被作為方案評(píng)審的考慮因素之一。

1.1應(yīng)征人擁有設(shè)計(jì)方案的著作權(quán)。征集人與中選方案的應(yīng)征人簽署了深化設(shè)計(jì)咨詢合同后，征集人可以使用應(yīng)征人遞交的概念方案設(shè)計(jì)成果。如果征集人未能與中選的應(yīng)征人簽署深化設(shè)計(jì)咨詢合同，未經(jīng)應(yīng)征人書面同意，征集人不得擅自使用應(yīng)征人的概念方案設(shè)計(jì)成果。

The Participant owns the copyright of the design scheme. After further design consultation contract is signed between the Sponsor and the Participant, the Sponsor can use the conceptual scheme of the Participant. If the Sponsor fails to sign the further design consultation contract with the Participant, the Sponsor shall not use the Participant’s conceptual scheme without the written consent of the Participant.

1.2征集人可對(duì)應(yīng)征人遞交的設(shè)計(jì)成果進(jìn)行印刷、出版和展覽，可通過傳播媒介、專業(yè)雜志、書刊或其他形式對(duì)設(shè)計(jì)方案進(jìn)行評(píng)價(jià)、展示和宣傳，但應(yīng)注明應(yīng)征人的名稱。在征得征集人書面同意后，應(yīng)征人可通過傳播媒介、專業(yè)雜志、書刊或其他形式評(píng)價(jià)、展示其設(shè)計(jì)方案的相關(guān)內(nèi)容。

The Sponsor may print, publish and display the design results submitted by the Participants, and may evaluate, display and publicize the design scheme through the media, professional magazines, books or other forms, but the name of the Participants shall be indicated. With the written consent of the Sponsor, the Participants can evaluate and display the relevant contents of the design scheme through the media, professional magazines, books or other forms.

1.3應(yīng)征人應(yīng)保證遞交的設(shè)計(jì)方案在中國境內(nèi)或境外沒有且不會(huì)侵犯任何其他人的知識(shí)產(chǎn)權(quán)（包括但不限于著作權(quán)、專利權(quán)）或?qū)Ｓ屑夹g(shù)或商業(yè)秘密。應(yīng)征人應(yīng)保證，如果其設(shè)計(jì)方案使用或包含任何其他人的知識(shí)產(chǎn)權(quán)或?qū)Ｓ屑夹g(shù)或商業(yè)秘密，應(yīng)征人已經(jīng)獲得權(quán)利人的合法、有效、充分的授權(quán)。應(yīng)征人因侵犯他人知識(shí)產(chǎn)權(quán)或?qū)Ｓ屑夹g(shù)或商業(yè)秘密所引起的全部賠償責(zé)任應(yīng)由應(yīng)征人承擔(dān)。

Participantshall ensure that the submitted Design PROPOSAL has not infringed upon and will not infringe upon IPR (including but not limited to copyright and patents) or proprietary technologies or trade secrets of others within or outside the People’s Republic of China. Participant shall guarantee that if his Design PROPOSAL uses or includes IPR or proprietary technologies or trade secrets of others, Participant shall have already obtained legitimate, valid and sufficient authorization from the right holders. Participant shall take all liabilities arising from infringement by the Participant upon IPR or proprietary technologies or trade secrets of others.

1.4在征集過程中征集人提供的設(shè)計(jì)基礎(chǔ)資料（包括設(shè)計(jì)圖紙、設(shè)計(jì)資料等）的知識(shí)產(chǎn)權(quán)屬征集人及相關(guān)設(shè)計(jì)單位所有。應(yīng)征人僅可以將上述文件用于編制《應(yīng)征文件》之目的。未經(jīng)征集人書面許可，應(yīng)征人不得將上述文件用于其他工程設(shè)計(jì)或其他目的，也不得將上述文件泄露給任何第三方。

The IPRs of the basic design information (including design drawings, design materials, etc.) provided by the Sponsor during the solicitation process belong to the Sponsor and related design organizations. Participants can only use the documents aforementioned for the purpose of designing and compiling the PROPOSAL. Without written consent from the Sponsor, Participants shall not use the documents aforementioned for other engineering designs or other purposes, and shall not disclose the documents aforementioned to any third Party.

1.5本次征集的設(shè)計(jì)深度為建筑概念方案設(shè)計(jì)。本次征集涉及的建設(shè)工程的方案設(shè)計(jì)、初步設(shè)計(jì)和施工圖設(shè)計(jì)將按照《中華人民共和國招標(biāo)投標(biāo)法》的規(guī)定通過公開招標(biāo)確定設(shè)計(jì)單位。

The depth of solicitation is architectural conceptual scheme。The scheme design, preliminary design and construction drawing design of the construction projects involved in this solicitation will be determined through public bidding in accordance with the provisions of the bidding law of the People’s Republic of China.

2.適用法律/ Governing Laws

本次征集活動(dòng)本身及與本次活動(dòng)相關(guān)的文件所適用的法律和法規(guī)僅為中華人民共和國的法律和法規(guī)。

The solicitation per se and any documents relating thereto shall be governed only by the laws and regulations of the People’s Republic of China.

3.語言/ Languages

《資格預(yù)審文件》使用中文和英文書寫。在中、英文兩種語言的意思表達(dá)不一致時(shí)，以中文為準(zhǔn)。資格預(yù)審《申請(qǐng)文件》、與征集人和征集代理之間的往來函電和文件均應(yīng)使用中文書寫。申請(qǐng)人隨《申請(qǐng)文件》提供的證明文件和印刷品可以使用另一種語言，但必須附以中文譯本。

The language used in the Prequalification Documents shall be Chinese and English. In the event of any discrepancy between Chinese and English, Chinese shall prevail. APPLICATION DOCUMENTS for Prequalification and the correspondence and documents related to this solicitation between Participants and the Sponsor shall all be drafted in Chinese. Another language can be used for the proof documents and printed materials that Participants provide along with the APPLICATION DOCUMENTS, but the version with Chinese translation shall be attached thereto.

4.解釋權(quán)

本次征集活動(dòng)及相關(guān)文件的最終解釋權(quán)歸征集人。
